A Spanish immigration lawyer advises and represents foreign nationals in all procedures relating to their legal status in Spain: residence permits, visas, Spanish nationality, family reunification and appeals against refusals, both at the administrative stage and before the courts.
The statutory period for a decision is one year from submission (art. 11.3 of Royal Decree 1004/2015) and administrative silence is deemed a refusal. In practice, processing usually takes between one and three years. Where no decision is issued, you can file a complaint and even bring judicial review proceedings before the Spanish courts (contencioso-administrativo). A well-prepared application avoids requests for further documentation and reduces delays.
Arraigo is a residence permit granted on exceptional grounds. Since 20 May 2025, under the new Spanish Immigration Regulation (Royal Decree 1155/2024), there are five categories: social, socio-labour, socio-training, family and second chance. The social, socio-labour and socio-training categories generally require two years of presence in Spain; family arraigo requires no minimum period of presence. All categories include the right to work, although in the socio-training arraigo the work authorisation is limited so as to remain compatible with the training.

Depending on the type of decision, you may file an administrative appeal (reposición or alzada, with a one-month deadline) and a judicial review application before the Spanish courts (two-month deadline, art. 46 of the Spanish Act governing the Contentious-Administrative Jurisdiction, LJCA). It is essential to act within the deadline and with a strategy suited to your specific case.
It is the permit for international remote workers provided for in Law 14/2013: it allows you to live in Spain while working remotely for companies or clients located outside the country. You must prove the employment or professional relationship, your qualifications or experience, and sufficient income. It can be applied for from within Spain or at the consulate.
